What makes me a Massachusetts resident for tax purposes?
Q. I have not resided in Massachusetts since Sep 2002. I have not lived in the US since Jul 2004. I have lived overseas. My home of record has remained Massachusetts, but I don't know if I have been shortchanging myself on tax returns. Should I be claiming non-resident or is there something else I can do? I am active duty military.
Asked by stupid people make me laugh!!! - Sun Jan 25 15:00:54 2009 - United States - 1 Answers - Comments
A. Since you are active duty military, your domicile does not change when you are posted out-of-state. You are a MA resident and since you are overseas you can NOT change it. You can only change your legal domicile to a state that you actually reside it. Since you are not currently residing in any US State, you cannot change your domicile. Warning: MA is one of those states that will pursue you for tax evasion if you change your domicile to avoid paying MA taxes. If you change your domicile to another state and then return to MA on your ETS, MA will presume that your only reason for the change in domicile was to evade payment of MA income taxes. There is no SOL on tax evasion so they can go back over a full 20 year or longer military career… [cont.]

Do the Senators and Representatives of Massachusetts support the public option although it has already failed?
Q. Massachusetts public option has already failed and they are now rationing health-care. Something that Obama has swore up and down would never happen under his plan. When the public option has already failed in MA, Canada, UK, France, and other European countries why would we even consider it? I feel like we saw all these other places metaphorically fall off a cliff and now we're following right after them. Are the Democrats really that stupid or are they just after the power, no matter the cost?

A. First of all Barney Frank - need I say more BTW it also failed in Maine and Tennessee, you'd think that they would learn, but again history repeats itself over and over because people refuse to acknowledge that their ideas don't work. After all they would have to give credit to other ideas.

How long does Massachusetts allow for the completion of estate administration?
Q. I need to cite the statute for a time limit on completion of estate administration in Massachusetts. I found the one that limits the commencement of probate, but can not find one that limits when it must be completed. Thank you in advance for any assistance.
Asked by Hotsauce - Mon Nov 28 10:22:05 2011 - Law & Ethics - 1 Answers - Comments
A. It can take as long as necessary to be "reasonable" to all parties concerned. For instance, there could be a lawsuit, or a series of lawsuits, appeals, and such, making it last for ten years or more. Or it could be over in a matter of a few months, having heard from all the creditors, paid them and distributed the residual.

How can I become a Massachusetts State Resident?
Q. I live in Puerto Rico but during 2008-2012, I will be studying in Massachusetts. If I study in UMass, being a resident gives a wonderful discount on tuition. How many years must I live there or what else is needed to become a Massachusetts Resident?

A. To qualify for in-state tuition you need to live in the state for 1 year. Move there, get an apartment, get a job, register to vote there, get your drivers license there, pay taxes there... and after a year you'll be a resident who qualifies for cheaper tuition.

What is the Massachusetts procedure for getting a driver's permit and lincense?

A. "Obtaining a Class D Permit and License" from the MA DMV: details the documents and forms (and $30 fee) that you need to take the written (multiple choice and on a computer, last I checked) exam (and vision exam) needed to get the learner's permit. The only difference between 18 is that if you are 18 you need proof of MA residency. To get a license, you need the permit, another form and fee, and pass the road test. (You need to provide a licensed sponsor over age 21, and also a vehicle, for the road test.) If you are <18, you also need a parental consent form, and have completed a state driver's education course (with certifercate). You may also want the driver's ed. certifercate for a discount on your auto insurance, as well,… [cont.]

What to see on a road trip from Massachusetts to Florida?
Q. My best friend and I are leaving on a road trip from our hometown in Massachusetts to her sister's place in Jupiter, Florida. What do you recommend we see/do on the way? A. Not much to see on 95 as you travel southbound. DC is first and worth several days. South Of The Border is nothing like it used to be and kinda' dumpy now, but still worthy of a souvenir. Charleston SC is 2 hours out of the way and if you're not a history freak...absolutely not worth it. Savannah is just a complete downer. The next thing to see along the route is probably the best thing on the whole trip. The big blue sign that says... Welcome To Florida.

A. Go to and in the upper left hand corner, enter your zip code. On the next screen, you will get information on the nearest SCORE chapter. Call them and arrange for a free meeting with a SCORE counselor. SCORE is a nonprofit association dedicated to entrepreneur education and the formation, growth and success of small business nationwide. SCORE is a resource partner with the U.S. Small Business Administration (SBA). SCORE has 389 chapters in locations throughout the United States and its territories, with 10,500 volunteers nationwide. Both working and retired executives and business owners donate time and expertise as business counselors.

A. It's normally pretty easy to do that. I would imagine that you would have to contact The Mass Education Dept. and get and submit the forms along with a fee.
